国立予防衛生研究所=現国立感染症研究所が早稲田大学文学部の真裏、閑静な住宅地である新宿区戸山に移転してくることが突然、周辺住民、早大に伝えられたのは1986年のことである。まさに寝耳に水の話だった。この施設がどのような性格の研究所で、実際にどのような活動を行っているのかが明らかになるにつれて、住民と早稲田大学教職員の疑念と不安は高まった。88年には建設工事着工が強行され、これに対して住民と早大教職員は89年、国を相手に移転差し止めを求めて東京地裁に提訴を行った。2001年に原告敗訴、東京高裁に控訴し、03年にまたも原告敗訴、最高裁でも05年上告が棄却された。本書は、最高裁が「取り返しのつかない惨禍」を生み出しかねない危険を指摘した本裁判の記録であり、全国で繰り広げられているバイオ施設、病原体研究施設の建設反対運動の理論的支えとなるものである。
