平成15年の労基法の改正を機に、労働契約法の制定が本格的に議論されるようになりました。すなわち、この改正法の付帯決議に基づいて、平成16年4月に厚労省が学識経験者による「今後の労働契約法制の在り方に関する研究会」を立ち上げ、同会の17年の研究報告をもとに、「労働政策審議会・労働条件分科会」における法案作成のための具体的検討が開始されました。その後、種々の議論を経て、紆余曲折の末に平成19年12月5日に法律第128号として公布され、平成20年3月1日に施行されることとなりました。本書では、新法の内容を1条ごとにQ&Aで分かりやすく説明していただきました。
